Unpaid autumn leave and eligibility for daily allowance

An employment relationship may include periods when work and salary payments are temporarily interrupted, such as during school holidays. In the unemployment security system, these periods are referred to as periods comparable to layoffs.

You may be entitled to earnings-related daily allowance for periods comparable to layoffs, even if your employment is full-time. It is important that unpaid leave periods are agreed upon when drafting the employment contract and that they are explicitly mentioned in the contract. If there is no such mention, the right to daily allowance for periods comparable to layoffs does not apply.

Applying for and receiving the allowance

Earnings-related daily allowance may be paid either in full or adjusted, depending on whether the employment is full-time or part-time. Please note that adjusted daily allowance can also be paid if you have a part-time job alongside your full-time employment or if you are self-employed part-time.

Remember that your job search must be active with the TE Office in order for the daily allowance to be paid, even in situations comparable to layoffs. Unpaid autumn leave in part-time work

If your employment is part-time, you have likely already applied for adjusted daily allowance from the beginning of your employment. Continue to apply for the daily allowance according to your normal application rhythm, even if the application period includes an unpaid autumn leave. Any salary paid during the adjustment period will be considered for the entire application period.

If you’re only applying for daily allowance for the autumn leave, the salary paid during the adjustment period will still be taken into account when calculating the allowance. Generally, the allowance will not be paid in full, even if you only apply for the unpaid leave week and even if the payday does not fall within the leave week. The adjustment period is always four calendar weeks or a month, and any salary paid during this period will be adjusted accordingly.

Unpaid autumn leave in full-time work

Eligibility for daily allowance can only arise from periods comparable to layoffs, so the application should only be made for the unpaid autumn break week. Submit your application for the entire calendar week (Monday-Sunday). For example, if your employment contract states that your unpaid autumn break is from 14th to 20th October 2024, you should submit your application for the entire week of 14th-20th October 2024. You can submit your application 20th October 2024 at the earliest.

The right to the daily allowance requires that unpaid periods are mentioned in your employment contract. The application must include the employment contract and a weekly work hour report for the hours worked before the leave. The weekly hour report can be completed by either your employer or yourself. If you have a part-time job in addition to your full-time employment, submit the employment contract for that job as well. The salary from the part-time work will be considered in the adjustment process, and the daily allowance for the unpaid leave week will typically be paid as adjusted.
